This Bike Rental Agreement (“Agreement”) is between you (“Renter,” “you,” or “your”) and Jamet Inc/Newnan Ride (“Company,” “we,” “us,” or “our”) and governs your rental of electric bicycles (“Bike” or “Bikes”) through our website NewnanLINCRide.com and associated mobile app (the “Service”). By completing a rental transaction, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
1. Rental Period & Fees
- Rental Term. Your rental term begins when you pay the rental fee for the Bike and ends when the Bike is properly docked at the authorized station.
- Rental Fees. You agree to pay the rates displayed in the app or on our website, including any per-minute, hourly, or daily charges, plus applicable taxes and fees.
- Grace Period. A brief grace period (e.g., 5 minutes) may apply for returning a Bike; usage beyond that grace period is billable.
- Overtime & Late Fees. If you keep the Bike past your paid rental period or fail to return it within 24 hours of unlocking, you will incur additional overtime fees and possible criminal charges.
2. Security Deposit & Payment Authorization
- Deposit Hold. We may place a temporary hold (“security deposit”) on your credit or debit card for incidentals (e.g., damage, late fees). This hold will be released within 7–10 business days after return, less any charges you incur.
- Automatic Billing. By renting a Bike, you authorize us to charge your payment method for all rental fees, additional charges (damages, theft, late fees), and applicable taxes.
3. Renter Obligations
- Eligibility. You must be at least 18 years old, hold a valid government-issued photo ID, and—if required by local law—possess a valid driver’s license.
- Traffic Laws & Safety. You agree to obey all traffic and trail laws, wear a helmet at all times, and yield to pedestrians.
- Bike Use. Bikes are for solo use only; no towing, no stunts, no modification of the Bike or docking equipment.
- Property Care. You will not damage, deface, or misuse the Bike. You must report any malfunction or damage immediately via phone (678-749-0757) or to support@newnanlincride.com.
4. Damage, Loss & Theft
- Damage Charges. You are responsible for any damage to the Bike occurring during your rental period, up to the full replacement cost if the Bike is irreparable.
- Lost or Stolen Bikes. You will be charged the full replacement value listed in the app if a Bike is not returned to an authorized dock or is reported stolen while in your possession.
- Unauthorized Use. You remain liable for the Bike until you have sent a text photo of the bike properly docked at the approved station.
5. Waiver of Liability & Indemnification
- Assumption of Risk. Bicycling involves inherent risks, including collision, falls, and mechanical failures. You assume all risks associated with using the Bike and indemnify and hold harmless Jamet Inc, its officers, directors, employees, and agents from any claims, losses, or liability arising out of your use of the Bike.
- Release. You release Jamet Inc from all liability for personal injury or property damage sustained by you or third parties resulting from your use of the Bike, except to the extent caused by our gross negligence or willful misconduct.
6. Insurance
- Renter’s Insurance. You understand that the Company does not carry personal injury or property insurance covering you. You are responsible for any medical or property damage costs you incur.
7. Termination & Suspension
- Company’s Right. We may suspend or terminate your rental and your access to the Service at any time for violation of this Agreement, illegal use, safety concerns, or non-payment of fees.
- Renter’s Right. You may end your rental at any time by docking and locking the Bike at an authorized station and confirming the end of your trip via text. If the bike malfunctions and is unridable through not fault of your own, you will be reimbursed a prorated amount of your remaining time or you can opt for a free ride on a later date. Please report any malfunctions immediately by text, phone, or email.
8. Dispute Resolution
- Informal Resolution. Please contact support@newnanlincride.com to resolve any disputes or billing inquiries.
- Governing Law. This Agreement is governed by the laws of Georgia, without regard to conflict-of-law principles.
- Venue. Any litigation must be filed in the state or federal courts of Coweta County, Georgia.
9. Miscellaneous
- Entire Agreement. This document, together with any fee schedules and our Terms of Service and Privacy Policy, constitutes the entire agreement between you and the Company.
- Severability. If any provision is unenforceable, the remainder will remain in full force.
- Amendments. We may update or modify this Agreement; changes will be posted at NewnanLINCRide.com. Continued use of the Service after posting constitutes acceptance.
